These Terms and Conditions ("Terms") govern your access to and use of DAILYQUEST (the "Service"), operated by Mariba Holdings (PTY) LTD ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

DAILYQUEST is a digital platform designed to help individuals, families, schools, and organisations create, manage, and participate in quests, goals, tasks, rewards, and related activities.

The Service is provided via a web application and may later include Progressive Web App (PWA) or mobile versions.

3. Eligibility and Accounts

3.1 Age Requirements

The minimum age to use DAILYQUEST is 10 years old.
Users under the age of 18 must have their account created, supervised, or managed by a parent, legal guardian, or teacher.

By allowing a minor to use the Service, the responsible adult confirms that they consent to the minor's use and accept responsibility for their activity.

3.2 Account Responsibility

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Ensuring information you provide is accurate and up to date

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

Use the Service for unlawful purposes
Submit false, misleading, or harmful content
Harass, abuse, or harm other users
Attempt to gain unauthorised access to the Service or its systems
Interfere with the security or operation of the platform

We may remove content or restrict access if these rules are violated.

5. User Content

Users may submit content such as notes, reminders, messages, quest descriptions, or comments ("User Content").

By submitting User Content, you:

Retain ownership of your content
Grant us a non-exclusive, royalty-free licence to use, store, and display the content solely to operate the Service

You are responsible for ensuring your content does not infringe the rights of others.

6. Subscriptions and Payments

Some features of DAILYQUEST require a paid subscription.

6.1 Payment Processing

Payments are processed by third-party providers, including PayFast and PayPal.
We do not store credit card or banking details.

6.2 Billing and Records

We may store limited payment-related information, including:

Transaction IDs
Subscription status
Payment amounts and dates

Failure to pay may result in suspension or termination of access to paid features.

7. Communications

By using the Service, you consent to receive:

Transactional and account-related emails
Subscription and billing notices
Product updates and marketing communications

Opt-out controls for non-essential communications may be introduced in future updates.

8. Intellectual Property

All content, software, designs, logos, and trademarks related to DAILYQUEST are owned by or licensed to Mariba Holdings (PTY) LTD.

You may not copy, modify, distribute, or exploit any part of the Service without prior written permission.

9. Service Availability

We aim to keep DAILYQUEST available and reliable but do not guarantee uninterrupted or error-free operation.

We may:

Modify or discontinue features
Perform maintenance
Suspend access temporarily or permanently

We are not liable for losses resulting from downtime or changes to the Service.

10. Termination

We may suspend or terminate your access if:

You violate these Terms
You misuse the Service
Required payments are not made

Users may request account termination via hello@mariba.co.za. Automated deletion features are planned.

11. Disclaimers

DAILYQUEST is provided on an "as is" and "as available" basis.

We make no warranties regarding:

Accuracy of content
Fitness for a particular purpose
Results achieved through use of the Service

Use of the Service is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Mariba Holdings (PTY) LTD shall not be liable for:

Indirect or consequential damages
Loss of data, profits, or business
Personal injury arising from misuse of the Service

13. Indemnification

You agree to indemnify and hold harmless Mariba Holdings (PTY) LTD from any claims, damages, or expenses arising from:

Your use of the Service
